PLEASE TAKE NOTICE that I, Joy Ann Monforte, Tax Collector for the Town of Denning, Ulster County, State of New York, have received the tax roll and warrant for the collection of taxes within the Town of Denning for the year 2012.

Taxes will be collected at the Denning Town Hall, 1567 Denning Road, Claryville, N.Y. 12725 on Monday thru Thursday from 8:30 A.M. to 3:30 P.M., and at the Catskill Hudson Bank, in the Cannie D's Plaza, Route 55, Neversink, N.Y. 12765 and by mail to the Town of Denning P.O. Box 277, Claryville, N.Y. 12725.

Taxes will also be collected on Sunday January 29th, 2012 from 1 P.M. to 4 P.M. at the Denning Town Hall.

PLEASE TAKE FURTHER NOTICE that taxes may be paid on or before the 31st day of January without interest. On all taxes received after such date there shall be added interest of one percent of the amount of the unpaid taxes for each month or fraction thereof until taxes are paid or until the return of unpaid taxes to the Ulster County Department of Finance pursuant to law.

NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN, that the New York State Department of Environmental Conservation ("DEC") has issued a Water Supply Permit under Article 15, title 15 of the New York State Environmental Conservation Law which both authorizes and limits New York City Department of Environmental Protection ("DEP") ability to purchase land within the New York City Watershed West-of-Hudson River as a component of DEP's water quality protection program. The Water Supply Permit is for a period of 10 years with an additional 5 year renewal (permit will expire in January, 2026).

Under Special Condition No. 1 of the Water Supply Permit, DEP can purchase in fee or in conservation easements during the term of the permit up to 105,043 acres in land.

Special Condition No. 2 of the Water Supply Permit provides as follows:

Land (or land subject to conservation easements) purchased by DEP are forever restricted from future residential or commercial development and must remain as open space.

Special Condition 10 of the Water Supply Permit identifies areas within each community that from an environmental, social and economic perspective should remain unrestricted in order to insure that the amount of developable land in the community is sufficient to accommodate future generations.

Under Special Condition 10 of the Water Supply Permit, the Town Board is given limited discretion to pass a resolution making a decision whether to allow DEP (and/or the Watershed Agricultural Council ("WAC") as agent for the City) to purchase certain parcels and place restrictions prohibiting future residential and/or commercial development on parcels that have been identified as important to the long-term sustainability of the community.

Under Special Condition 10, the Town Board has discretion whether to prohibit the City (and/or its agents) from purchasing parcels or conservation easements located in Areas denoted as the 1997 Designated Hamlet Area.

The Town Board has scheduled a public hearing on May 10, 2011 at 7 P.M. at the Denning Town Hall to provide the public an opportunity to comment on these determinations.

Written comments may be submitted to the Town Clerk at the following address: Denning Town Hall, P.O. Box 277, Claryville, N.Y. 12725. Comments may also be submitted to the Town Clerk by email at the following address: townhall@denning.us.

All written comments must be submitted by 5 P.M. on May 9, 2011.

Under Special Condition 10 of the Water Supply Permit, the Town Board has a limited period of time to pass resolutions addressing these issues.

The Town Board does not anticipate being able to extend the public comment period.

Further if previously married a divorce decree, or Certificate of Disposition or attorneys affidavit clearly stating a valid divorce is recognized by the State of New York must be shown.

The officiant does not have to be a resident of New York State and is not required to register with the State of New York. However the marriage must take place with in the borders of New York State.

The material must be of such grade as to be acceptable to the Town of Denning Highway Superintendent. Sand for all locations shall be screened, clean, hard sharp and free from loam, clay, frozen lumps, loam or organic material with 100% passing through a 3/8 inch sieve.

Upon acceptance of bid price, bidder shall in turn notify the Town of Denning Highway Superintendent when he has at least 100 tons of material stockpiled in order that the testing may be done by the Highway Department or by a designated agent for final approval.

PLEASE TAKE NOTICE

The Town of Denning Planning Board will be holding a Public Hearing for the purpose of issuing a Logging Permit on SBL 42-1-27.3 / 27.112 / 27.111 / 27.2 / 27.12 located on Frost Valley Road, owner of record Laura Brock Smith.

Property is under the 480A Forest Tax Law and the timber harvest is a requirement of that Law. Number of acres to be harvested approximately 140, number of trees to be harvested around 1045, and number of board feet to be harvested approximately 182,054.

The Public Hearing will be held just prior to the start of the regularly scheduled Planning Board Meeting, at the Denning Town Hall, 1567 Denning Road, Claryville, NY 12725, on Thursday, February 10, 2011, and starting at 7 PM. All interested person(s) will be heard at said time.
