PLEASE TAKE NOTICE that I, Joy Ann Monforte, Tax Collector for the Town of Denning, Ulster County, State of New York, have received the tax roll and warrant for the collection of taxes within the Town of Denning for the year 2010.

ANNUAL ELECTION OF THE CLARYVILLE FIRE DISTRICT
NOTICE IS HEREBY GIVEN that the Annual Election of the Claryville Fire District will take place on December 8, 2009 between the hours of 6:00 p.m. and 9:00 p.m. at the Claryville Fire House located on Denning Road, for the purpose of electing one Commissioner for a five (5) year term, commencing January 1, 2010 and ending December 31, 2015. Legal Notice of Public Hearing on the Budget of the Claryville Fire District
NOTICE IS HEREBY GIVEN that the Proposed Budget of the Claryville Fire District of the Town(s) of Denning and Neversink, State of New York, will be presented to the Board of Fire Commissioners of the Claryville Fire District, for its consideration.
A PUBLIC HEARING will be held at 7:00 p.m. at the Claryville Fire Department Community Hall, 1500 Denning Road, Claryville, New York in the Town of Denning, State of New York on the 20th day of October, 2009.
Pursuant to Town Law §105, the Board of Fire Commissioners must hold a public hearing on the budget, make the proposed budget available to the public prior to the public hearing, allow the public to comment on the budget at the public hearing. This public hearing must be held to allow maximum public participation in the hearing.
The purpose of the public hearing is to allow any person to be heard in favor of or against the proposed budget as it is submitted, or for or against any item or items contained in the proposed budget, and hearing all persons interested in the subject concerning same.

The Town of Denning will hold a PUBLIC HEARING on Saturday, August 15, 2009 at the Claryville Volunteer Fire Department Community Hall, 1500 Denning Road, Claryville, N.Y. 12725. The purpose of SAID public hearing to consider the re-draft and re-codification of the Town of Denning Subdivision Review Regulations set to begin at 9:30 A.M. Any and all interested person(s) shall be heard at SAID time. Copies of the June 29, 2009 proposed "Draft Town of Denning Land Subdivision Regulations" are available in the Town Clerk's Office during normal business hours and on the Town's website. It is proposed to comprehensively modify and recodify the subdivision law based on the Town of Denning Comprehensive Plan adopted in October 2007. Main topics addressed in the modified, new and reorganized sections of code include:
- Declaring intent to supersede Town laws, if needed.
- Clarifying and adding to 'Definitions', now Article VII.
- Establishing protocol for lot line adjustment (LLA), including establishing when a lot line adjustment is not a subdivision and that a hearing is not required for a LLA.
- Providing for different types and levels of fees and taking the specific monetary amounts out of the code and instead placing the responsibility for annually setting fees with the Town Board.
- Providing an initial conference procedure (Section 220) with the Planning Board, including resource analysis and conceptual discussion. Also, encouraging early conferences at the same point with the Town Highway Superintendent and external agencies, such as Ulster County Planning and Board of Health.
- Establishing separate requirements for Minor and Major (five or more lot) subdivisions. Consistent with the Ulster County Charter, there is a local determination to allow the exemption of minor subdivisions from referral to the County Planning Board.
- Placing more responsibility for road and access layout and review with the Town Highway Superintendent, including associated stormwater infrastructure development and connections.
- Requiring development agreements in cases involving private access rights of ways to new lots.
- Enhancing standards for roads, including cul-de-sac (dead end street) length, and guidelines for allowed road grades, curvature and associated clearing.
- Establishing some flexibility in the allowable lot geometry and in the arrangements of lots within a subdivision in order to promote natural resource conservation.
- Establishing and expanding on the procedure for required improvements, making it a separate part of the code (Article V).
- Expanding the plan submission requirements (now Article VI) 'checklists' of items required at each stage.
- Incorporating the enforcement ordinance into the code.

RESOLUTION # 37 - Denning Town Audit Meeting - July 14, 2009
WHEREAS, New York State Town Law 60-a.2 authorizes the Town Board to reduce the number of Town Justices by the adoption of a resolution, subject to permissive referendum, and
WHEREAS, the Town Board has determined that it will be in the best interests of the Town to reduce to one justice, and
WHEREAS, one of the Justices of the Town has resigned effective July 20, 2009, and
WHEREAS, his term of office will expire on December 31, 2009.
NOW THEREFORE BE IT RESOLVED that the Town of Denning will reduce the number of Town Justices from the current number of two (2) to one (1) effective January 1, 2010, and
NOW THEREFORE BE IT RESOLVED that the resolution will not take effect until thirty days after its adoption, or if subjected to permissive referendum until it is approved by the affirmative vote of a majority of the qualified electors of the Town.
FURTHER BE IT RESOLVED that SAID resolution be published in the official newspaper of the Town of Denning Ye Olde Tri Valley Townsman.
Motion to adopt and approve by Councilman Mike Dean 2nd by Councilman Paul Schoonmaker, All in favor. Motion carried by a 4 to 0 vote.
