    to Update Denning's Land Use Codes




    What's first on the revise zoning project agenda.

          Denning is updating its land use laws. The codes being considered for refinement include the subdivision regulations, zoning, and local laws covering the siting of telecommunications facilities and manufactured housing. Subdivision control involves the development of new lots, roads and access to lots (driveways).

          The subdivision regulations were selected as the first phase of the project to upgrade Denning's land use laws. The current subdivision regulations were adopted in 1975.

          The Committee to Update Dennings Land Use Codes developed the attached draft subdivision law for community consideration. Denning landowners and residents are encouraged to review and provide comments and questions on the draft regulations. The existing subdivision code was last updated in the 1970s. The revisions presented here are based on the Comprehensive Plan adopted in late 2007 (also available by scrolling below). The Town of Denning Planning Board, Town Board, and Ulster County Planning are simultaneously reviewing this draft.

          A Public Hearing on the Draft Code is scheduled for Saturday, August 15, 2009 at 9:30am at the Fire Hall in Claryville all interested persons are invited and encouraged to attend. Questions and comments may also be submitted via the Town Clerk via email or letter (Town Clerk contact information is available elsewhere on this website). Subdivision regulation is the control of the division of a tract of land into smaller individual lots and the layout of associated access (roads) by requiring adherence to design standards and procedures adopted by local regulation. Subdivision review is a procedure framed by state statutes.

    Status Report on the Project to Update to Dennings Land Use Codes.

          The Committee to Update Denning's Land Use Codes continues to meet regularly and consider refinements to the Town's land use laws. The project scope includes updates to the subdivision and zoning laws. The next regular project meetings are: Monday, November 10 and Monday, November 24 in the Denning Town Hall meeting room in Claryville. Meetings are open to the public - they start at 7:00 p.m. and last until 9:00. Anyone interested is invited to attend.

          Meeting summaries, agendas and supporting information are posted here on the Town website: www.denning.us under 'Revised Zoning Project'. These materials may also be reviewed at Town Hall during normal business hours: Monday, Wednesday and Thursday from 9:30 a.m. to 1:30 p.m.

          After updating the comprehensive plan in late 2007, the Town Board began this project by forming a committee to guide project development. The codes are being refined to ensure that future development fits Denning’s rural character. In April the Committee held an outreach meeting to discuss proposed changes in the subdivision review law. Since then, the group has met six times. The committee is making its preliminary revisions to the subdivision code (last modified in 1975) and zoning. In coming months the group will continue its consideration of changes to these local laws. After the New Year the group will caucus with the Planning Board. Then, the proposed laws would be presented for broader review and comment. There likely will be another outreach meeting scheduled to update residents and property owners in mid-winter or early spring.
